Revision of social sector size restriction (bedroom tax or spare room subsidy)

Introduction

The Department for Work and Pensions (DWP) has confirmed that a small number of social housing tenants should not have been affected by the spare room subsidy, or 'bedroom tax'. If you have been continuously in receipt of housing benefit since 1st January 1996 and have occupied the property since that date then this change may affect you.

The DWP has issued new regulations which are effective from 03.03.2014 and close the above issue. Therefore any exemption from a spare room deduction will only apply between 01.04.2013 - 02.03.2014. From 03.03.2014 all affected claimants will again be subject to the social sector size restriction rules. The Housing Benefit team are writing to all the customers affected, to advise them of revised housing benefit awards.


It is possible to be exempt from the spare bedroom deduction even if there has been a break in your entitlement so long as:

  • the break was no longer than 4 weeks
  • or, if the break was because you or your partner was a welfare to work beneficiary, then the break was no more than 52 weeks

Where tenants have succeeded the tenancy rights to the property then they may still be treated the same providing that the criteria are met.

If there is evidence that your circumstances meet the above rules, the benefits team will remove the size of criteria charge back to 1 April 2013.
